We hope that the information laid out below regarding both the use of the Web Site and also bookings with us will be helpful in understanding how we work; please do not hesitate to contact us for any additional information.

TERMS AND CONDITIONS FOR USE OF THE WEBSITE

​

  1. By accessing information on our website it is assumed that you accept our terms and conditions of use.

  2. It is very important to note that the website does not give all the information related to each tour, service or destination, this information can be viewed in relevant itinerary documents and the booking terms and conditions information.

  3. Despite our efforts, errors can appear on the website concerning pricing and/or information or prices may have changed between publication on the website and the time of booking therefore it is vital that you read carefully all the information provided at the time of booking.

  4. Our booking terms and conditions do contain information concerning limitations and exclusions of our liability to any person(s) who books and/or participates on any of our holidays and/or travel services.

  5. Access to this website is conditional on your agreement that all matters arising concerning any content on this website shall be governed and judged in accordance to Ecuadorean law and each party agrees to submit all such matters to the exclusive jurisdiction of the Ecuadorean courts only to the exclusion of the Courts in/of any other country.

TERMS AND CONDITIONS APPLICABLE TO BOOKING A TOUR

​

Please read these Terms set out below -and our Privacy Policy and any other information referenced in this document.

 

​

I. CONTRACT:

1. Following receipt of a written request or a booking, we will send out a Quotation -that is subject to change up to the time of confirmation of the booking, or a Confirmation & Invoice.

 

​

II. PAYMENT:

​

  1. Pre-payment of 30% of the total amount is required upon confirmation to be paid to us directly (for certain tours – for example a Galapagos Islands ‘add-on’, a larger deposit may be necessary). Any fees involved in transferring money to us will have to be covered by yourself. We will send details of the various payment methods available.

  2. Full payment must be received by us at least 60 days prior to the start of your trip with us. Exceptions will be clearly explained in the Confirmation & Invoice.   3. If the booking request is made less than 70 days prior to the start of the trip, the payment must be 100% of the amount.

III. TRAVEL INSURANCE:

​

A travel insurance is not included – not provided by us. Appropriate travel medical insurance is mandatory* and proof of such a policy will be required prior to starting any tour/using any services booked through us; we also advise guests to take out a policy covering their belongings while travelling.

*please note, increasingly countries are not allowing visitors to enter the country without proof of valid health insurance.

IV. PASSPORTS, VISA, CUSTOMS AND HEALTH REQUIREMENTS:

​

Clients are responsible for ensuring that they travel with all the necessary up to date documents and comply with all regulations in order to enter and travel in the respective country/countries including valid passport (for most destinations valid at least six months after the planned date of LEAVING that country; a certain number of blank pages are also often required for entry/exit stamps), visa, customs and health requirements. This information can be obtained from the relevant institutions (Consulate, Customs Offices, Travel Health Centre...) and must be checked carefully by clients.

V. CANCELLATION:

​

COVID-19: We have put in place helpful and supportive booking conditions for our guests, which recognise the very difficult situation. Please check with us to find out about the special applicable cancellation policies)

​

  • Cancellations must be communicated to us in writing. The following cancellation fees will generally apply but, as tours are offered in several countries, it is essential that you make yourself aware of the cancellation policy for the tour to wish to book: â€‹

  • From 70 to 41 days before departure: 50% of the value of the tour booked.

  • From 40 to 0 days before departure: 100% of the value of the tour booked.

  • Up to 70 days before departure: the prepayment (30%) will not be refunded.

​

  • Payments that have already been made to us, will be refunded according to the cancellation fees mentioned above minus our administration costs (usually only bank fees) and any payments made on your behalf that are not refundable (for example flights).

  • Certain service providers such as hotels or airlines (or others) may have special payment and cancellation conditions, which will be mentioned in the Confirmation & Invoice.


We will not be held responsible for additional expenses in case of cancellation or extension of the journeys because of, for example, meteorological or safety conditions. As well, please note that the itinerary can change because of circumstances outside our control such as weather conditions.

VI. CANCELLATION DUE TO FORCE MAJEURE:

​

  1. f the journey due to unpredictable happenings (e.g. war, riots, natural catastrophe, global warming, epidemics, strikes, terrorist activity and its consequences or any unavoidable event beyond our control) is hampered, endangered or impaired, the traveler or provider are entitled to terminate the contract. We reserve the right to claim for compensation for expenses that may occur.

  2. In case of cancellation due to Force Majeure during the trip, we will undertake all necessary measures, especially with regard to transporting the client to the end point or back to the start point of the tour or other appropriate place. Possible costs have to be assumed by the traveler.

VII. ALTERATION OF TRAVEL AFTER COMMENCEMENT OF TRAVEL:

If a client requests any modification after the booked tour/services have started, we will try to help with the arrangements, but cannot guarantee that it will be possible. The client has to cover any additional costs due to cancellation or re-booking arrangements.

VIII. LIABILITIES AND LIMITATIONS OF LIABILITIES:

​

  1. Clients will be requested to sign a WAIVER OF LIABILITY, Release of Liability, and Assumption of Risk agreement prior to participating on any of the tours/services arranged by us. We will not be able to allow clients to participate on any tours/services provided without having signed our Waiver of Liability Agreement. The agreement includes releasing liability of the owners, employees, shareholders, affiliated entities, employees, agents, representatives, officers, directors, associates, volunteers, successors and assigns from and against any liability, actions, causes of actions, debts, suits, claims and demands of any and every kind and nature whatsoever which a client has or which may hereafter arise out of or in connection with their tour or participation in the activities arranged for them by the company.

  2. Our liability does exclude the personal belongings of clients, therefore we strongly recommend acquiring an appropriate travel insurance policy prior to travelling.

IX. JURISDICTION:

​

  1. All matters concerning a booking with us shall be governed and judged in accordance to Ecuadorean law and each party agrees to submit all such matters to the exclusive jurisdiction of the Ecuadorean courts only to the exclusion of the Courts in/of any other country. The place of court is in Ecuador.

​

XI. CONFIDENTIALITY:

​

The client’s personal data provided will be treated as strictly confidential (please also refer to privacy policy).
